Vulnerability is one of the least examined concepts in research ethics. Vulnerability was linked in the Belmont Report to questions of justice in the selection of subjects. Regulations and policy documents regarding the ethical conduct of research have focused on vulnerability in terms of limitations of the capacity to provide informed consent. Other interpretations of vulnerability have emphasized unequal power relationships between politically and economically disadvantaged groups and investigators or sponsors. So many groups are now considered to be vulnerable in (...) the context of research, particularly international research, that the concept has lost force. In addition, classifying groups as vulnerable not only stereotypes them, but also may not reliably protect many individuals from harm. Certain individuals require ongoing protections of the kind already established in law and regulation, but attention must also be focused on characteristics of the research protocol and environment that present ethical challenges. Pettit and List argue for realism about group agency, while at the same time try to retain a form of metaphysical and normative individualism on which human beings qualify as natural persons. This is an unstable and untenable combination of views. A corrective is offered here, on which realism about group agency leads us to the following related conclusions: in cases of group agency, the sort of rational unity that defines individual rational unity is realized at the level of a (...) whole group; rational unity is never a metaphysical given but always a product of effort and will; just as it can be realized within groups of human beings it can also be realized within parts of human beings, as well as within whole human lives; in cases of group agency, the rational unity that is achieved at the level of the group typically precludes rational unity at the level of its human constituents within their whole lives, though it can be realized within parts of those human lives. Along the way, a contrast is drawn between cases of genuine group agency and the cases of political agency envisaged by Rousseau and Rawls (and by Pettit and List) which leave individual human beings intact as separate agents in their own rights. The concept of solidarity has recently come to prominence in the healthcare literature, addressing the motivation for taking seriously the shared vulnerabilities and medical needs of compatriots and for acting to help them meet these needs. In a recent book, Prainsack and Buyx take solidarity as a commitment to bear costs to assist others regarded as similar, with implications for governing health databases, personalized medicine, and organ donation. More broadly, solidarity has been understood normatively to call for ‘standing with’ or (...) assisting fellow community members and possibly also distant others in regard to their needs, whether for its own sake or in order to realize the demands of justice. I argue here that the understanding of solidarity in the existing bioethics literature is unduly restricted by not sufficiently theorizing the notion of structural (or systemic) injustice and its import for understanding solidarity. Extending traditional conceptions of labor and social movement solidarity, I contrast unitary solidarity within a given group with ‘networking solidarities’ across groups. I analyze the meaning of structural injustice and its significance for solidarity, including countering institutionally entrenched inequalities and economic exploitation. I then apply this broadened conception to healthcare, discussing structural problems with the U.S. insurance system and the solidarity movements addressing its deficiencies. I analyze some natural disasters and global health challenges that were aggravated by structural injustices, along with the solidarity movements they engendered. Finally, I revisit the questions of governing health databases and of personalized medicine with the enlarged conception of solidarity in view. (shrink)

: Despite its amazing morphological diversity, life as we know it on Earth today is remarkably similar in its basic molecular architecture and biochemistry. The assumption that all life on Earth today shares these molecular and biochemical features is part of the paradigm of modern biology. This paper examines the possibility that this assumption is false, more specifically, that the contemporary Earth contains as yet unrecognized alternative forms of microbial life. The possibility that more than one form of life arose (...) on Earth is consistent with our current understanding of conditions on the early Earth and the biochemical and molecular possibilities for life. Arguments that microbial descendents of an alternative origin of life could not co-exist with familiar life are belied by what we know of the complexity and diversity of microbial communities. Furthermore, the tools that are currently used to explore the microbial world – microscopy (with the aid of techniques such as DAPI staining and fluorescence in situ hybridization), cultivation and PCR amplification of rRNA genes – could not detect such organisms if they existed. Thus, the fact that we have not discovered any alternative life forms cannot be taken as evidence that they do not exist. (shrink)

Traditional conceptions of informed consent seem difficult or even impossible to apply to new technologies like biobanks, big data, or GMOs, where vast numbers of people are potentially affected, and where consequences and risks are indeterminate or even unforeseeable. Likewise, the principle has come under strain with the appropriation and monetisation of personal information on digital platforms. Over time, it has largely been reduced to bare assent to formalistic legal agreements. To address the current ineffectiveness of the norm of informed (...) consent, I suggest that we need a notion of structural injustice (on a distinctive interpretation, elaborated here, which takes account of unequal power and property relations). I then argue that in order to protect and enhance people's freedom, we have to go beyond traditional applied ethics and introduce perspectives from democratic theory and social philosophy. I attempt to show how applications of the ‘all‐affected principle’, together with new forms of democratic participation, deliberation, and representation can helpfully frame the narrower principle of informed consent. There is an important role for what we could call collective consent, and informed consent can only succeed in increasing individual agency if it is situated within enhanced forms of democratic decision‐making. En noviembre de 1976, Amnesty Internacional llegó al país a constatar denuncias sobre violaciones a los derechos humanos. Dos de sus integrantes llegaron a la ciudad de Córdoba. El Hotel Crillón, ubicado en plena city cordobesa y locación donde se alojaron los visitantes, fue el escenario de las acciones de espionaje, persecución y amedrentamiento que sufrieron los dos delegados, un varón y una mujer, que habían llegado para contactarse con posibles denunciantes. Al no poder constituirse como un refugio seguro para (...) expresar aquello que las autoridades negaban, el artículo analiza cómo se frustró esta visita en base a los informes elevados por la Policía Federal a través de un memorando reservado. En la misma se contextualiza el momento, apoyándonos en la historia de la represión local, y se procura una lectura analítica del documento resguardado en el Archivo Provincial de la Memoria de Córdoba. Asimismo, se ofrece su cotejo y contraste con otras informaciones provenientes de testimonios vertidos en diferentes momentos. ¿Cómo y por qué se frustró la visita? ¿Quiénes tuvieron contacto con los visitantes y por qué no fue posible contactar a los familiares y allegados de la/os represaliada/os? ¿Qué testimonios posteriores se conocieron de este acontecimiento frustrado? ¿Cómo habrá incidido en la costosa configuración de la cuestión de los derechos humanos en Córdoba, algo que hemos demostrado en nuestras investigaciones previas del tema? Coming more than a decade after I first argued that people who are oppressed have an obligation to resist their oppression, this paper expands the implications of the original account and connects it up to some of the important contemporary work published in oppression studies in the interim. I then move on to respond to two critical objections to my view. The first objection charges that the typical severity of oppressive harms is not sufficiently great to ground a general obligation (...) of resistance. The second objection charges that this project would do better to conceive of resistance in political, rather than moral, terms. (shrink)

This paper explores the conduct of performance appraisals of nurses in a New Zealand hospital, and how fairness is perceived in such appraisals. In the health sector, performance appraisals of medical staff play a key role in implementing clinical governance, which, in turn, is critical to containing health care costs and ensuring quality patient care. Effective appraisals depend on employees perceiving their own appraisals to be fair both in terms of procedure and interaction with their respective appraiser. We examine qualitative (...) data from interviews and focus groups, involving 22 nurses in a single department, to determine whether perceived injustices impact on the effective implementation of the appraisal system. Our results suggest that particular issues had been causing some sense of injustice, and most of these were procedural. Potential solutions focus on greater formalisation of the performance appraisal process, and more training for appraisers and appraisees. (shrink)

In this essay, I consider the question of whether women have an obligation to confront men who sexually harass them. A reluctance to be guilty of blaming the victims of harassment, coupled with other normative considerations that tell in favor of the unfairness of this sort of obligation, might make us think that women never have an obligation to confront their harassers. But 1 argue that women do have this obligation, and it is not overridden by many of the considerations (...) that can override other obligations to confront wrongdoers. (shrink)

This paper is an attempt to identify certain consonances between contemporary liberalism and classical pragmatism. I identify four of the most trenchant criticisms of classical liberalism presented by pragmatist figures such as James, Peirce, Dewey, Addams, and Hocking: that liberalism overemphasizes negative liberty, that it is overly individualistic, that its pluralism is suspect, that it is overly abstract. I then argue that these deficits of liberalism in its historical incarnations are being addressed by contemporary liberals. Contemporary liberals, I show, have (...) taken on board a surprising number of classical pragmatist insights and have responded to a surprising number of classical pragmatist criticisms. I thus argue that both contemporary pragmatism and contemporary liberalism have much to gain by joining forces. (shrink)

Abstract: The emergence of cross-border communities and transnational associations requires new ways of thinking about the norms involved in democracy in a globalized world. Given the significance of human rights fulfillment, including social and economic rights, I argue here for giving weight to the claims of political communities while also recognizing the need for input by distant others into the decisions of global governance institutions that affect them. I develop two criteria for addressing the scope of democratization in transnational contexts— (...) common activities and impact on basic human rights —and argue for their compatibility. I then consider some practical implications for institutional transformation and design, including new forms of transnational representation. (shrink)

This essay offers distance and stillness as means by which to access and understand the dynamism of cities. I reflect on stillness as an unexpected aesthetic within artistic projects that represent urban environments, and as a vital approach to engaging with such artworks. Focusing on Lagos, Nigeria, I consider one photographic series by Abraham Oghobase and one sound work by Emeka Ogboh. I read their work in light of philosopher Jeff Malpas’s conceptualization of place as “existential ground.” In considering this (...) relational aspect of place, I ruminate on the way distance facilitates the careful looking and listening that connects artist, object, and viewer/listener through stillness. Eukaryotic chromosomes end with tandem repeats of simple sequences. These GC rich repeats allow telomere replication and stabilize chromosome ends. Telomere replication involves an equilibrium of sequence loss and addition at the ends of chromosomes. Repeats are added de novo by telomerase, an unusual DNA polymerase. Telomerase is an RNP in which an essential RNA component provides the template for the added telomere repeats. Telomere length maintenance plays an essential role in cell viability.

This article takes up Marilyn Strathern’s formulation of a law/culture ‘duplex’ – her term for the complementarity of anthropology and law as means to each other’s ends. She draws attention to the limitations of the duplex, and urges us to consider ethnography as (in part) a project of unwinding its entwinement. As a step toward that end, the article returns to classic texts by Emile Durkheim and Bronislaw Malinowski – texts that were foundational to the emergence of anthropology, and to (...) the establishment of law as an object of study for the social sciences. Re-read in light of Strathern’s insight, what has been widely taken as their relativism emerges instead as their defense of political community as a subject for ethnography, and (accordingly) the basis for a theoretical check on law conceived globally – within states or as colonial overrule. The article concludes with a discussion of the contemporary relevance of that position. (shrink)

The development of the internet and other communications technologies over the past decade have seen a corresponding growth in the development and use of technologically-based research methodologies. This paper explores issues arising from the new technology which impact on ethics committees and how these might be addressed. Whilst some ethical issues are comparable in both online and offline worlds there are some elements of the techno-research which require extra consideration. Although ethics guidelines can be found on the worldwide web the (...) onus remains upon techno-researchers and ethics committee members to collaborate in deciding upon the ethical dilemmas and the rigour of proposed techno-research solutions. Feminists have celebrated success in gendering security discourse and practice since the end of the Cold War. Scholars have adapted theories of contentious politics to analyze how transnational feminist networks achieved this. I argue that such theories would be enhanced by richer conceptualizations of how transnational feminist networks produce and disseminate new forms of global governmental knowledge and expertise. This article engages social movement theory with theories of global governmentality. Governmentality analysis typically focuses upon governmental power rather than political contention (...) or the collective agency of political outsiders. However, I argue that governmentality analysis contributes to an account of feminist influence on the fields of development and security within global politics. The governmentality lens views politics as a struggle over truth and expertise. Since experts have authority to speak the truth on a given issue, governmentality analysis seeks to uncover the social basis of expertise. Such analysis of expertise can illuminate important aspects of the power of movements. The power of transnational women’s movements lies in production and dissemination of knowledge about women within global knowledge networks. (shrink)
